New York Public Health Law section 2801-d authorizes private actions by patients of residential health care facilities for actions that deprive patients of any right or benefit defined in the law for patient well-being. Section 2801-d applies to any deprivation of right or benefit that causes injury, including not only physical harm to a patient but also emotional harm, death or financial loss. Compensatory damages at a minimum must be at least 25% of the daily per-patient rate of payment or average daily total charges per patient for the facility, for each day the injury exists. Punitive damages are expressly allowed where the deprivation of any right or benefit is found to have been “willful or in reckless disregard of the lawful rights of the patient.” This might include restraining or medicating a patient without any medical justification to do so, or physically, verbally or emotionally abusing a patient.
