Our boating accident lawyers report on the Long Island Sound Water tube accident that injured two teens.

A boating accident involving a water tube over the weekend resulted in two 13-year-old girls being sent to the hospital. One ended up with a broken pelvis. The water tube was being towed in Long Island Sound at the time, and it threw the two teenagers into the water when it hit a large yacht 69 feet in length.

After the impact, the occupants of the yacht jumped into the water to rescue the two unconscious girls. One of the rescuers was the father of one of the girls. The reaction at the time was to dial 911 and ask for assistance.

As soon as they were able, the Fairfield Police Marine Unit rushed to the aid of the victims and they were transported to a hospital where currently one of the girls has sufficiently recovered and is able to walk, while the second girl is suffering from a broken pelvis.

North Carolina is the home of one of the girls, while the other is from Long Island. The owner of the yacht is also from Long Island and was maneuvering the smaller boat that was towing the tube when the accident took place. It is reported that he is a relative of the two victims.

At this point, the reason for the accident has not been confirmed, but there is no reason to believe that any charges will be brought against the operator of the tow boat.

This accident is a stark reminder that the summer season is also the boating season. Not all those out on the water at the helm of a boat of any type are necessarily capable of handling the vessel competently. Fortunately, unlike a similar accident last year on Long Island Sound, when a teenager’s life was lost and another was inflicted with a serious life-changing leg injury, this incident only resulted in one significant injury.

Speed is often a factor when accidents like these take place. Some boats, particularly when towing another vessel, don’t always react in the way the person at the helm expects them to. It may be then too late to avert an accident. Potential victims are often taken by surprise and aren’t given enough time to escape injury.

In this case, the families of the victims may well just overlook the reason for the accident and not take any further action against the boat operator, who appears to be a family member. If the accident had taken place between strangers, the victims and their families may think it appropriate to file a compensation claim against the person who caused the accident.

As with driving a vehicle on a road, a boat operator owes a duty of care both to passengers and others on the water to avoid an accident. If a boat operator was either intoxicated or navigated in a reckless manner, causing an accident and associated serious injuries, and the victims are able to prove fault, then they may be able to file a personal injury compensation claim.

This is a legal entitlement in New York and is in place so that victims of accidents who have been injured may be relieved of the financial burden caused by an accident. They may also recover an amount for pain and suffering and punitive damages if the person at fault was proven to have been negligent. It is essential to contact an experienced New York and Long Island personal injury attorney like Richard S. Jaffe Esq. who will help decide if you have a sound claim for being awarded compensation.
